COMMENT The aim of the threshold criteria is to establish whether the child is suffering or likely to suffer significant harm if left in the care of its natural parents, indicating that the child is beyond parental control. Since the introduction of the Human Rights Act 1998, the court must be satisfied that such an order does not contravene Article 8, which guarantees a right to family life. Consequently, the court must be satisfied that any intervention is proportionate to the legitimate aim of protecting family life.
