preliminary reference

Definition

noun
  • a reference from a court in a Member State of the European Union to the European Court of Justice on a question of interpretation of EU law
COMMENT The aim of a preliminary reference is to ensure that the laws are interpreted uniformly throughout the EU, and that all national courts are familiar with it. The ECJ has used preliminary references as a means of extending the scope of EU law.
