  • a clause in a statute which deems what should be taken to be the case if the actual situation is unclear
COMMENT A deeming provision creates a legal fiction that minimises delays. For example, it can assume that legal documents will have been received and read by their intended recipient within two days of service, even if this is not confirmed. Proceedings can then continue.
